These Terms of Service (“Terms”) govern your use of the website at trianglesuperiorwallsandepoxy.com (the “Site”) operated by Triangle Superior Walls & Epoxy (“we”, “our”, or “us”). By using the Site, requesting an estimate, or texting with us, you agree to these Terms.
1. Use of the Site
You may use the Site to learn about our services, view our work, and request an estimate. You agree not to use the Site in any way that violates applicable law, infringes our intellectual property, interferes with normal operation, or harvests data through automated means without our written consent.
2. Estimates and Quotes
Estimates requested through this Site are non-binding until a written quote or service agreement is signed by both parties. Any pricing, time-to-complete, or warranty language shown on the Site is for general information only — the final terms of your project will be set in your signed estimate or service agreement.
3. Intellectual Property
All content on the Site, including text, images, before/after photos of completed projects, logos, and the “Triangle Superior” brand, is owned by or licensed to Triangle Superior Walls & Epoxy. You may not copy, reproduce, or redistribute content from the Site without our written permission.
4. User-Submitted Content (Photos)
Our estimate and contact forms allow you to optionally attach photos of the space you want us to work on. These Terms govern any image you upload to the Site (each, a “Submission”).
4.1 Your representations. By uploading a Submission, you represent and warrant that:
- you are at least 18 years old (or have a parent or legal guardian's permission, and your parent or legal guardian agrees to these Terms on your behalf);
- you own the Submission, or you have all rights, licenses, consents, and permissions necessary to upload it and to grant the license in Section 4.2;
- the Submission does not infringe any third party's copyright, trademark, trade secret, right of publicity, right of privacy, or any other intellectual property or proprietary right;
- the Submission does not contain any of the prohibited content listed in Section 4.3;
- any identifiable people, vehicles, license plates, property, or private documents visible in the Submission have been included with appropriate consent.
4.2 License to us. You retain ownership of your Submissions. By uploading a Submission, you grant Triangle Superior Walls & Epoxy a limited, non-exclusive, worldwide, royalty-free, sublicensable license to host, store, copy, transmit, display, and process the Submission strictly for the purposes of: (a) understanding the scope of your project, (b) preparing a quote, (c) planning and performing the work, (d) communicating with you about the work, (e) sharing it internally with our crew, subcontractors, CRM, and storage providers, and (f) keeping reasonable business records for warranty, dispute, tax, and legal compliance purposes. This license ends when we delete the Submission under our retention policy or at your request, whichever comes first.
We will not use your Submission in marketing, advertising, social-media content, our before/after gallery, our website, or any other public-facing context unless you give us separate, explicit, written permission.
4.3 Prohibited content. You agree that you will not upload any photo or other content that:
- is unlawful, fraudulent, defamatory, threatening, harassing, or invasive of another person's privacy;
- depicts a minor in a sexualized manner, or contains any child sexual abuse material (CSAM). Any such content will be removed, preserved as required by law, and reported to the National Center for Missing & Exploited Children (NCMEC) and/or law enforcement, together with the submitter's name, contact information, IP address, and any other available identifying data;
- depicts non-consensual sexual content, intimate images of another person shared without consent, or other sexually explicit material;
- depicts graphic violence, gore, self-harm, or content intended to shock or harass our staff;
- promotes terrorism, mass violence, or other illegal activity, or contains threats against any person or group;
- contains hate speech, slurs, or content targeting a person or group based on race, ethnicity, national origin, religion, disability, gender, gender identity, or sexual orientation;
- contains malware, viruses, or other harmful code, or attempts to overload, probe, or otherwise interfere with our infrastructure;
- infringes any third party's intellectual property, privacy, publicity, or contractual rights, or violates any applicable law or regulation.
4.4 Our rights. We are not obligated to monitor Submissions, but we may review, refuse, remove, or delete any Submission at any time, in our sole discretion, with or without notice. We may also suspend the account, IP address, or contact information associated with any submitter who violates these Terms, and we may report violations to law enforcement or other appropriate authorities. We are not responsible for any failure or delay in removing prohibited content.
4.5 Indemnity. You agree to indemnify, defend, and hold harmless Triangle Superior Walls & Epoxy, its owners, employees, subcontractors, and service providers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to any Submission you upload, including any claim that a Submission infringes a third party's rights, violates a third party's privacy, or violates any law.
4.6 DMCA / copyright complaints. If you believe that a photo or other content on this Site infringes your copyright, you may send a notice that complies with the Digital Millennium Copyright Act (17 U.S.C. § 512) to our designated agent:

Your notice must include: (i) a physical or electronic signature of the copyright owner or someone authorized to act on their behalf; (ii) identification of the copyrighted work claimed to be infringed; (iii) identification of the material claimed to be infringing and information sufficient to locate it; (iv) your contact information; (v) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (vi) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act on the copyright owner's behalf. We will respond to valid notices in accordance with the DMCA.
5. No Warranties
The Site itself is provided “as is” without warranties of any kind, either express or implied. We do not warrant that the Site will be uninterrupted, error-free, secure, or virus-free.
Warranties on completed flooring, epoxy, and wall-system work are governed by the signed estimate or service agreement for that project, not by these Terms.
6. Limitation of Liability
To the maximum extent permitted by law, Triangle Superior Walls & Epoxy shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of the Site, including loss of profits, loss of data, or business interruption, even if we have been advised of the possibility of such damages. Our total aggregate liability arising from your use of the Site shall not exceed one hundred dollars (US$100).
7. Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in Wake County, North Carolina for any dispute arising from these Terms or your use of the Site.
8. Changes to the Terms
We may update these Terms from time to time. Material changes will be reflected by an updated “Last updated” date at the top of this page. Continued use of the Site after a change constitutes acceptance of the updated Terms.
9. SMS / Text Message Terms
How our text message service works. When you submit a contact form on this Site, call a phone number listed on this Site, or text one of our tracking numbers, you are giving us permission to text you back about your inquiry, your appointment, your quote, and related project updates. Messages may include appointment confirmations, quote details, missed-call follow-ups, and occasional promotional offers. All promotional messages include the brand name “Triangle Superior” and the keywords STOP and HELP.
When you opt in to the Text Message Service, we may send you a message to confirm your signup. Message and data rates may apply. Message frequency varies. Text HELP for help. Text STOP to cancel.
Cancellation. You can cancel this service at any time by texting STOP to the number you received messages from. After you send STOP, we will reply to confirm that you have been unsubscribed, and you will no longer receive messages from us. If you want to join again, simply opt in the same way you did the first time.
Help. If at any time you forget what keywords are supported, text HELP to the number you received messages from. We will respond with instructions on how to use the service and how to unsubscribe.
Participating carriers. AT&T, Verizon Wireless, T-Mobile, Sprint, U.S. Cellular, Boost Mobile, MetroPCS, Virgin Mobile, Cricket, and most other US mobile carriers. Carriers are not liable for delayed or undelivered messages.
